Andrew Hetherington has represented clients in a wide variety of complex commercial disputes, including breach of contract, securities, antitrust, False Claims Act, and theft of trade secrets litigation.  Mr. Hetherington also has assisted clients in connection with federal criminal investigations involving allegations of securities fraud and espionage.

Noteworthy Representations

National Credit Union Association – Represented National Credit Union Administration, as liquidating agent, in lawsuits against defendants including Goldman Sachs, Credit Suisse and UBS, regarding claims that defendants violated securities laws in conjunction with the issuance of residential mortgage-backed securities.  Each case settled before trial.  More than $5.1 billion has been recovered.

CUNA Mutual Group – Represented CUNA Mutual in a lawsuit alleging that Credit Suisse violated securities laws in conjunction with the issuance of residential mortgage-backed securities.  The case settled on the first day of trial.

Louisiana Pacific Corporation and The Anschutz Corporation – Prosecuted federal and state securities law claims and common law claims brought by institutional investors against investment banks and brokers, arising from purchases of structured finance securities with an auction rate securities pricing mechanism.

In re Refco Securities Litigation – Prosecuted federal securities law and RICO claims as well as common law claims brought by an institutional investor against an accounting firm and international law firm, arising out of the collapse of Refco, Inc.

In re Chocolate Antitrust Litigation – Represented plaintiffs in antitrust class action.

Verizon New England Inc. v. RNK, Inc. – Represented Verizon in breach of contract action against competitive local exchange carrier to enforce terms of an Interconnection Agreement. 

Samuel Glazer v. Lehman Brothers, Inc. et al. – Prosecuted fraud and breach of fiduciary duty claims brought by investor against broker-dealers.

United States ex rel. Wright v. Chevron U.S.A., Inc. – Represented qui tam plaintiff in False Claims Act case against major oil and gas manufacturers.

Global NAPs, Inc. v. Verizon New England Inc. – Represented Verizon in breach of contract action against competitive local exchange carrier to enforce terms of an Interconnection Agreement.
